Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and June AI Apps LTD ("ChatIt", "we", "us", or "our") and govern your access to and use of the ChatIt application, the websites at https://getchatit.com and https://app.getchatit.com, and related services (collectively, the "Service"). Please read them carefully.

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization. If you do not agree to these Terms, do not use the Service.

2. Eligibility & Accounts

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. You are responsible for the accuracy of your account information, for maintaining the confidentiality of your credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. The Service

ChatIt provides a unified interface to interact with various third-party artificial intelligence models, enabling you to send prompts and content and receive generated responses. We may add, modify, or discontinue features at any time. We do not guarantee that any particular model, provider, or feature will remain available.

4. AI-Generated Content

The Service uses artificial intelligence to generate responses ("Outputs"). Outputs are produced by automated systems and may be inaccurate, incomplete, outdated, or offensive, and may not reflect the views of ChatIt. You are solely responsible for evaluating Outputs before relying on them.

Outputs are not professional advice. The Service does not provide legal, medical, financial, or other professional advice. Do not rely on Outputs as a substitute for advice from a qualified professional. Given the nature of machine learning, Outputs may not be unique, and similar Inputs by other users may produce similar Outputs.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party right;
  • Generate or distribute content that is illegal, harmful, harassing, defamatory, hateful, or sexually exploitative of minors;
  • Infringe intellectual property rights or misappropriate trade secrets;
  • Develop, train, or improve a competing product, or attempt to reverse engineer or extract underlying models;
  • Circumvent rate limits, usage restrictions, or security measures, or access the Service through unauthorized automated means;
  • Transmit malware, attempt to gain unauthorized access, or disrupt the integrity or performance of the Service;
  • Engage in fraud, impersonation, or activity that could mislead others about AI-generated content; or
  • Use the Service in violation of the usage policies of the underlying AI providers.

We may investigate and take action, including suspension or termination, for any suspected violation.

6. Your Content & License

"Inputs" means the content you submit to the Service, and "Outputs" means the content generated in response. As between you and ChatIt, you retain ownership of your Inputs and, to the extent permitted by law and the applicable provider terms, you own the Outputs generated for you.

You grant ChatIt a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display your Inputs and Outputs solely to operate, provide, secure, and improve the Service, including transmitting Inputs to the AI provider you select. You represent that you have all rights necessary to submit your Inputs and that they do not violate these Terms.

7. Intellectual Property

The Service, including its software, design, text, graphics, logos, and the ChatIt name and marks, is owned by June AI Apps LTD or its licensors and is protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights. You may not copy, modify, distribute, sell, or lease any part of the Service.

8. Subscriptions & Payments

Certain features require a paid subscription. Prices and features are described at the point of purchase. Unless otherwise stated:

  • Subscriptions automatically renew at the end of each billing period until cancelled.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period, and you retain access until then.
  • Purchases made through the Apple App Store are billed by Apple and managed through your Apple account, subject to Apple's terms. To cancel, use your App Store subscription settings.
  • Except where required by law, payments are non-refundable and there are no refunds or credits for partial periods.

We may change prices on a prospective basis with reasonable notice.

9. Third-Party Services

The Service relies on and integrates third-party services, including AI model providers and platform stores. Your use of those services may be subject to their separate terms. We are not responsible for third-party services and disclaim liability arising from them.

10. Termination

You may stop using the Service at any time and delete your account. We may suspend or terminate your access, with or without notice, if you violate these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination will survive.

11. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT OUTPUTS WILL BE ACCURATE OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL June AI Apps LTD, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

13. Indemnification

You agree to indemnify and hold harmless June AI Apps LTD and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your Inputs, your use of the Service, or your violation of these Terms or applicable law.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales, without regard to its conflict-of-laws rules. Subject to applicable mandatory consumer-protection laws of your country of residence, you and ChatIt agree to submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute arising out of these Terms or the Service.

15. Apple App Store Additional Terms

If you download the app from the Apple App Store, the following applies: these Terms are between you and June AI Apps LTD only, not Apple. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. In the event of a failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for product claims, intellectual-property claims, or legal-compliance claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government restricted-parties list.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms.
