Terms of Service

These Terms of Service ("Terms") govern your use of the ChatIt AI mobile application (the "App") operated by June AI Apps LTD ("we," "our," or "us"). By accessing or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

2. Description of Service

ChatIt AI provides access to multiple artificial intelligence models and tools, including but not limited to:

• Conversational AI interactions with various models (GPT-5, Claude, Gemini, DeepSeek, Llama, Mistral, Nova Pro, Grok)
• AI-powered image generation, editing, upscaling, and background removal
• Real-time web search integration
• Multimodal content support (text, images, files)
• Conversation history and management

3. User Accounts and Registration

3.1 Account Creation

You must create an account to use certain features of the App. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Age Requirements

You must be at least 13 years old (or 16 in the European Economic Area) to use the App. By using the App, you represent and warrant that you meet this age requirement.

4. Subscription and Billing

4.1 Subscription Plans

The App offers subscription-based access to premium features. Subscription details, including pricing and billing periods, are displayed in the App and through the Apple App Store.

4.2 Payment Processing

All payments are processed through Apple's App Store. Your subscription will automatically renew unless you cancel it at least 24 hours before the end of the current period. You can manage your subscription in your Apple App Store account settings.

4.3 Refunds

Refund requests are subject to Apple's App Store refund policy. We do not directly process refunds. Please contact Apple Support for refund requests.

4.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will apply to new subscribers immediately and to existing subscribers after notice and at the start of the next billing cycle.

5. Acceptable Use Policy

You agree not to use the App to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Transmit spam, chain letters, or other unsolicited communications
• Attempt to gain unauthorized access to the App or related systems
• Reverse engineer, decompile, or disassemble the App
• Use the App to develop competing products or services
• Generate content that promotes violence, hatred, or discrimination
• Create deepfakes or misleading content intended to deceive
• Attempt to bypass usage limitations or restrictions
• Automate access to the App through bots, scripts, or other automated means without authorization

6. Intellectual Property Rights

6.1 Our Rights

The App and its original content, features, and functionality are owned by June AI Apps LTD and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Rights

You retain all rights to the content you submit to the App ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service.

6.3 AI-Generated Content

Content generated by AI models through the App may be subject to the terms and conditions of the respective AI service providers. You are responsible for ensuring your use of AI-generated content complies with applicable laws and third-party rights.

7. User-Generated Content

You are solely responsible for your User Content. We do not pre-screen User Content but reserve the right to remove or refuse to process any User Content that violates these Terms or applicable laws.

8. AI Model Usage and Limitations

8.1 Service Availability

AI model availability may vary based on factors including demand, technical issues, and third-party provider limitations. We do not guarantee uninterrupted access to any specific AI model.

8.2 Output Accuracy

AI-generated content may contain errors, inaccuracies, or biases. You should independently verify any important information. We are not responsible for decisions made based on AI-generated content.

8.3 Usage Limits

We may impose reasonable usage limits to ensure fair access for all users and manage costs. Excessive usage may result in temporary restrictions or additional charges.

9. Service Availability and Modifications

We reserve the right to modify, suspend, or discontinue the App or any features at any time without notice. We will not be liable if all or any part of the App is unavailable at any time.

10. Disclaimers and Limitations of Liability

10.1 Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of AI-generated content
• Warranties of uninterrupted or error-free service
• Warranties that defects will be corrected

10.2 Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUNE AI APPS LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless June AI Apps LTD and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising out of or related to your use of the App, your User Content, or your violation of these Terms.

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at contact@getchatit.com to attempt to resolve the dispute informally.

12.2 Arbitration Agreement

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration, except where prohibited by law. You waive your right to a jury trial or to participate in a class action lawsuit.

13. Termination

13.1 Termination by You

You may terminate your account at any time by deleting the App and canceling your subscription through the Apple App Store.

13.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in conduct that we reasonably believe is harmful to other users, us, or third parties.

13.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where June AI Apps LTD is registered, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the new Terms in the App and updating the "Last Updated" date. Your continued use of the App after such changes constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and June AI Apps LTD regarding the App and supersede all prior agreements and understandings.
